HHS Opened the Door to 6 Unapproved Peptides (BPC-157, TB-500): RFK Jr. vs FDA Scientists

On October 28, 2026, HHS said it will not take enforcement action against licensed compounding pharmacies and doctors that make six unapproved peptides with a prescription: BPC-157, TB-500, epitalon, MOTS-c, KPV and semax. RFK Jr. says he has used peptides himself and that the ban "created the black market." FDA career scientists say there is scant evidence the peptides are safe or effective. HHS itself says the policy is not an FDA approval.

Team RFK

HHS Secretary Robert F. Kennedy Jr. told Joe Rogan in February 2026 that he is “a big fan of peptides” and has used them himself on a couple of injuries. HHS says the policy confronts a black market of bogus products sold as research chemicals.

Team FDA scientists

FDA career scientists objected that there is scant evidence these peptides are safe or effective (STAT). Reviewers found no published human safety studies for several of the six. CBS medical contributor Dr. Celine Gounder warned that peptides that promote blood vessel growth can also promote certain cancers.

Frequently asked questions

Is BPC-157 legal now?

Not approved. On October 28, 2026, HHS said it will not take enforcement action against state-licensed compounding pharmacies and physicians that make BPC-157 and five other peptides for a patient with a prescription. HHS says this does not grant FDA approval or establish clinical safety and effectiveness, and it is temporary while the FDA works on a permanent rule.

Which 6 peptides are covered by the HHS policy?

BPC-157, TB-500, epitalon, MOTS-c, KPV and semax. Each compounded product can contain only one of these peptides.

Can I buy these peptides without a prescription?

The policy covers compounding by licensed pharmacies and physicians with a prescription. It does not cover research-chemical sellers or large outsourcing facilities (503B).

What did RFK Jr. say about peptides?

On The Joe Rogan Experience (episode 2461, February 2026) he said, "I'm a big fan of peptides. I've used them myself," and said he used them on a couple of injuries. HHS says the new policy confronts a black market of unregulated products.

Why do FDA scientists object?

FDA career scientists objected that there is scant evidence these peptides are safe or effective, according to STAT. Reviewers found no published human safety studies for several of them, and CBS medical contributor Dr. Celine Gounder warned that some peptides promote blood vessel growth, which can also promote certain cancers.

Can the public comment on the peptide policy?

Yes. HHS said the notice would appear in the Federal Register on October 30, 2026, with a public comment period.
